By placing a deposit, you acknowledge that you have received, read, understood, and agree to the terms set forth below, as well as in the separate letter of waiver and indemnity (the “Indemnity”). The Indemnity is incorporated by reference into the agreement and forms an essential part of the contract between you and the Tour Agency. You further agree that all conditions outlined in the Indemnity apply in full to your participation in the tour.
PAYMENT
1) A deposit equivalent to 20% of the total trip fee shall be paid to reserve a slot in this tour experience
2) The balance 80% fee shall be paid to MORE BETTER PTE LTD (the “Tour Agency”) at least ninety (90) days prior to the commencement of the trip. This payment shall be made in cash, cheque, bank transfer, or credit card (subject to 3.4% merchant fee) to the Tour Agency’s designated bank account.
– Failure to make full payment by the deadline may result in your removal as a tour participant. Any penalties, additional fees, or financial losses incurred by the Tour Agency due to your non-payment shall be borne by you.
– The Tour Agency shall not be responsible for any costs arising from trip cancellations due to non-payment. All cancellation charges as stated below will apply.
FORCE MAJEURE
3) You acknowledge and understand that the Tour Agency shall not be liable for any failure or delay in performing its obligations for this tour due to circumstances beyond its reasonable control, including but not limited to natural disasters, extreme weather conditions, pandemics, government restrictions, war, civil unrest, strikes, or any other unforeseen events (“Force Majeure Events”). In the event of a Force Majeure Event:
The Tour Agency will make reasonable efforts to mitigate the impact of the Force Majeure Event and will explore viable alternative arrangements, if possible.
The Tour Agency reserves the right to modify, postpone, or cancel the tour. If the tour is postponed, participants will be offered the option to reschedule the tour for a mutually agreeable date, subject to availability and any applicable price adjustments.
If rescheduling is not possible or desired by the participant, The Tour Agency will offer a refund of the tour cost, less any non-refundable deposits or expenses already incurred that cannot be recovered (e.g., permit fees, non-refundable transportation costs). The specific amount of the refund will be determined on a case-by-case basis, taking into account the circumstances and the extent to which the tour has been affected.
In cases where alternative arrangements are possible (e.g., an adjusted itinerary), you may be given the option to proceed with the adjusted itinerary at your own expense.
The Tour Agency will not be liable for any additional costs, or damages incurred by you due to a Force Majeure Event, including but not limited to travel expenses, accommodation costs, or lost wages. You are strongly encouraged to obtain comprehensive travel insurance to cover such potential losses.
4) The Tour Agency reserves the right to cancel or modify the itinerary of the tour experience in the event of circumstances beyond the Tour Agency’s control. These factors include, but are not limited to:
Unforeseen logistical issues encountered by vendors in the host country; and
Failure to meet the minimum number of participants required for the trip to proceed.
If the original tour experience is cancelled, and the Tour Agency is unable to arrange for an alternative tour or if the alternative is not acceptable to you, a full refund will be provided. The refund will be subject to deductions for any transaction fees and payments made to vendors (such as flights, deposits, etc.). Any amount to be refunded to you will be processed within 30 days from the date on which you had rejected alternative arrangements for the tour.
ITINERARY CHANGES
5) The Tour Agency reserves the right to modify the trip itinerary for safety reasons. These include but are not limited to the participants’ abilities to complete the activities, weather conditions, or any unforeseen circumstances beyond the Tour Agency’s control. Such modification may result in additional costs (such as hotel accommodation costs, and flight ticket change fees) that will have to be borne by you.
6) In the event that the duration of the tour exceeds the projected duration due to changes in routes for safety reasons, you agree that you shall be personally liable for any additional costs incurred, which may include, but are not limited to, changes in flights, extra accommodation, guide fees, and any applicable penalties or fees.
SAFETY CONSIDERATIONS
7) The safety of the participants is of utmost priority. In the event that you are assessed by either the staff at the Tour Agency or the local guides to be unfit or unable to continue due to sickness, injuries, or physical limitations, you may be asked to terminate your participation in the activity and/or the rest of the trip. In such an event, there shall be no refund of any fees that have been paid beforehand.
8) If you find it difficult to keep up with the pace of the group in any of the activities, you may be asked to hire an additional guide or transportation to accompany you as the rest of the group proceeds, or to turn back with a guide, in which case all additional costs shall be borne by you.
9) The Tour Agency reserves the right to refuse service before or during the trip due to disruptive behaviour, lack of physical fitness, and safety considerations. Disruptive behaviour may include but is not limited to: attempts of manipulation, bullying, rudeness, aggression, or lying. Lack of physical fitness may include but are not limited to concerns over pre-tour training, adequate preparation, and mental resilience affecting physical performance. Safety considerations can include but are not limited to refusal to follow safety instructions, excessive anxiety or fear that hinders progress, distrust, excessive negativity, and refusing to communicate.
10) In the event that the Tour Agency determines during the trip that you are not suited to continue with the trip for the reasons set out in Clause 8 above, there shall be no refunds of any payment made.
11) For the avoidance of doubt, for the purposes of Clauses 9 and 10, the local guides and/or the tour Agency has the sole discretion to determine whether you are suitable to embark on the trip and/or to continue with the trip.
CANCELLATION POLICY
12) You shall be entitled to the following refunds if you notify the Tour Agency of your withdrawal from the trip, based on the following notice periods:
90 days or more: Full refund, including your deposit, less a $200 administrative fee
Between 31-90 days: 40% of the total trip cost
30 days or less: No refund
Any amount to be refunded to you will be processed within 30 days from the date of cancellation.
You acknowledge and agree that the fees associated with securing accommodations, flights, and other services for the trip may have already been paid to third-party vendors. You further acknowledge that if the agency had already made any arrangements with vendors or airlines at the time of cancellation, you will be responsible for any additional costs exceeding the refund amount. The cancellation policy outlined herein is not intended as a penalty, but rather as a necessary provision to cover the costs incurred by the Tour Agency in arranging and securing these services on your behalf.
MEDIA PERMISSION
13) You hereby give your express permission to THE TRAVEL INTERN PTE LTD and the Tour Agency to use any media taken during the tour without the expressed written permission of those included within. Media produced during the tour may be used as publication, marketing, promotional material, on social media posts, reports and websites. You hereby grant THE TRAVEL INTERN PTE LTD and MORE BETTER PTE LTD a perpetual, worldwide, royalty-free license to use images, videos, and other media captured during the trip for promotional purposes. You can withdraw your permission to use any media taken during the tour by providing written notice at any time prior or during the trip.
GENERAL
14) This agreement shall be governed by and construed in accordance with the laws of Singapore.
15) You agree to submit to the non-exclusive jurisdiction of the Singapore Courts for the purposes of any action or court proceedings (including any summons, motion or petition) brought by us for or in relation to the recovery of our costs incurred or to be incurred by us on your behalf or in respect of our services to you.
16) You agree that all disputes and differences arising under, out of, or in connection with our agreement with you, or services provided by us to you, shall be referred to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed incorporated by reference to this clause. The place and seat of arbitration shall be Singapore. The dispute shall be determined by a single arbitrator, such arbitrator to be appointed by mutual agreement between us, or in the event that no mutual agreement is reached, then in accordance with the SIAC Rules. The arbitration proceedings shall be governed by the International Arbitration Act (“IAA”) and Part 2 of the IAA and the UNCITRAL Model Law shall apply. The language to be used in the arbitral proceedings shall be English.
